Data Privacy

Thank you for your interest in our Data Privacy Policy. The protection of your personal data is of great importance in all our company’s business processes. Below, we provide you with information about the data we collect during your visit to our website and how we use this data.

What is saved when you visit our website?
When you access our web pages, our web server temporarily records the domain names and/or IP addresses of the requesting computers, the file requests of the clients (file name and URL), the http response code and the website from which you are visiting us. From this data, which is stored in a technical log file (log file), it is not possible to trace which user has retrieved data. No other methods to identify users or to understand users’ access behaviour are used. Evaluation of the saved data is only carried out for statistical purposes without reference to individual persons.
Handling of personal data
Personal data such as your name, address, telephone number and e-mail address is only collected if you have voluntarily provided the relevant information on the web page in question. This applies to registrations for certain information services, newsletters, enquiries, surveys and more. The data collected in this way (master data) is used by us exclusively to provide the service being used or for the required purpose. Your data is used for the purpose of consulting, advertising and market research only with your consent. It is not passed on to third parties unless you have expressly consented to this or we are legally required to do so. You can revoke your consent at any time in writing or electronically for the future.
Duration of the storage of personal data
We save the data collected by us only for as long as is necessary and permissible for the respective agreed purpose and in compliance with the applicable law. Unless legal regulations require further processing (particularly the retention of data) or you have given your consent for us to do so, the data will be deleted at the end of the subsequent calendar year if the basis for the further saving of your master data no longer applies (for example following termination of an information service).

Data privacy information relating to the use of social media
1 General information
(1) We maintain publicly accessible profiles on various social networks (social media channels). Personal data (such as name, age, address, photos, e-mail addresses and IP addresses) is collected, used and stored when you visit and use these channels.

(4) When you visit our social media channels, personal data is collected, used and stored by us and by the operators of the respective social network, even if you do not have a profile on the respective social network or are not a registered user.
(5) The individual data processing operations and the nature and extent of the data processed vary according to the operator of the social network. To a large extent, we are neither aware of these processes nor can we influence them. Any information we have about these processes comes from the respective operators themselves. The processing may change from time to time.
(6) The same applies to the transmission of this data to third parties. Special justification is required if the operator of the respective social network transfers personal data to countries outside the scope General Data Protection Regulation (GDPR) (third countries), in particular to the United States of America (US). The previously applicable EU-US Privacy Shield resolution adopted by the European Commission (Privacy Shield) was declared invalid by the European Court of Justice (ECJ) ruling of 16 July 2020. Since then, the transfer of data to the US can only be legally based on the agreement of standard contractual clauses (SCCs), which are currently being revised by the EU Commission.
(7) For the processing of data in the context of a Facebook fan page, the ECJ decided on 5 June 2018 that joint responsibility applies on the part of Facebook and the owner of the Facebook fan page according to Article 26 GDPR. Such joint responsibility with the operator of the respective social network may also exist with other networks.
(8) You are neither legally nor contractually obliged to provide us or the respective operators with your personal data. However, such data may be required for the use of specific functionalities or all functionalities of our social media channels.
2 Data subject rights
As a data subject, you have the following rights vis-à-vis both ourselves and the respective operator of the social media channel:
The right, to the extent defined in Article 15 GDPR, to obtain information on the processing of your personal data;
The right, to the extent defined in Article 16 GDPR, to request immediate rectification of inaccurate personal data concerning you and/or the completion of incomplete personal data;
The right, to the extent defined in Article 17 GDPR, to request the immediate erasure of personal data concerning you;
The right, to the extent defined in Article 18 GDPR, to require the restriction of data processing concerning you;
The right, to the extent defined in Article 20 GDPR, to receive the personal data concerning you, which you have provided to us, in a structured and machine-readable format and to transmit those data to another data controller;
The right, to the extent defined in Article 21 GDPR, to object at any time on grounds relating to your particular situation to the processing of personal data concerning you, provided that the processing is based on an overriding interest or that your data is used for direct marketing purposes;
The right to revoke your consent to data processing at any time without affecting the legality of the data processing carried out up until revocation based on consent;

3 Type, scope and purpose of data processing
(1) If you use our social media channels to contact us (for example by submitting your own posts, responding to one of our posts or sending us private messages), we will process the data you provide solely for the purpose of contacting you. The legal basis for data collection is Article 6 (1) (a) and (b) GDPR. We delete data saved in connection with this contact after six months, as soon as the storage of such data is no longer necessary or when you request us to delete it; in case of legal retention obligations, we restrict the processing of the stored data accordingly.
(2) In addition, you will find details about the collection and storage of your personal data, as well as the nature, extent and purpose of their use by us and the operator of the respective social network, in the following information about the various social media channels and in the data privacy policies of the operators in question.
(3) Depending on the operating system used, you may use the available settings to restrict access to certain personal data (such as contact and calendar data, photos and location data), especially on mobile devices (smartphones, tablet computers).
Facebook and Instagram
(1) The operator of the social networks “Facebook” and “Instagram”, and the data controller according to Article 4 (7) GDPR, is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

(2) We maintain Facebook fan pages and Instagram profiles. When you visit our website, we, as a page owner, will be able to view only the information stored in your public Facebook profile. Furthermore, we will be able to do so only if you maintain such a profile and are logged into it while visiting our fan page or Instagram profile.

We have no control over or access to the usage data that Facebook itself collects to generate these statistics. However, Facebook has concluded an agreement with us relating to joint responsibility according to Article 26 (1) GDPR in which it commits to taking on primary responsibility according to the GDPR for the processing of this data, to fulfil all obligations arising from the GDPR with regard to this data and to provide you with the essential details of this obligation. This data processing serves our (and your) legitimate interest in specifically improving the user experience when visiting our fan pages. The legal basis for this data processing is therefore Article 6 (1) (1) (f) GDPR.
(3) On our fan pages, or via our Instagram profiles, you can interact with us by way of various functions. On Facebook, such functions include the service channel, Messenger, the comment function, the “Like” button and the “Subscribe” button. On Instagram, such functions include communicating publicly and privately, commenting on posts, liking posts and following us.
We use your personal data (such as user name, profile picture, date of interaction, age, gender, language, relationship status, information on occupation and education, hobbies and the content of your communication) for the purpose of responding on the basis of Article 6 (1) (b) GDPR. In addition (for example if you give us feedback on our products), we use such information for the protection of our legitimate interests under Article 6 (1) (f) GDPR.
Our legitimate interest lies in publicly effective communication; the improvement of our customer support; the improvement and further development of our business processes, marketing measures, products and services; business analysis; and brand creation.
(4) When you visit our Facebook fan pages or Instagram profiles, Facebook collects, among other things, your IP address, the application used, information about the end device you are using (such as device ID and application ID), information about websites visited, your location and your mobile phone operator. This data is linked to your Facebook profile and logged.
Facebook uses cookies which are stored on your device when you visit our fan pages even if you do not have your own Facebook profile or are not logged into it during your visit to our fan pages. These cookies allow Facebook to create user profiles based on your preferences and interests and to display advertisements tailored to you (inside and outside of Facebook or Instagram). We do not know, nor does Facebook definitely explain, how it uses the data from visiting Facebook pages and Instagram profiles for its own purposes, to what extent such activities are assigned to individual users, how long Facebook stores this data and whether data from your visit to our Facebook fan pages and Instagram profiles are passed on to third parties.
(5) Facebook also transfers personal data to third countries, in particular the US. In this respect, Facebook has declared that it will agree to SCCs instead of referring to the Privacy Shield in future.

YouTube
(1) The operator of the service “YouTube” and the data controller according to Article 4 (7) GDPR for users who have their usual residence in the European Economic Area or Switzerland is Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (Google).
For questions regarding privacy, you can contact Google via a special web form available at https://support.google.com/policies/contact/general_privacy_form.
(2) We use some YouTube videos as external content on our channels. If you interact with us via YouTube, for example through the “Discussion” tab, we process your personal data (such as user name and the content of your communication) for the purpose of responding based on Article 6 (1) (b) GDPR. In addition, we use such data (for example if you give us feedback on our products) for the protection of our legitimate interests under Article 6 (1) (f) GDPR.

(3) In addition, Google also collects your personal data such as your IP address, the application used, information about the end device you are using (such as device ID and application ID), information about websites accessed or your location. The same applies to your content or comments. Google uses cookies and other technologies to this end. This data is made available to us.
From the data collected, Google may create personal usage profiles and use them to send you personalised advertising or other content.

We use the content and your personal data (user name, profile picture, date and time of interaction) for the purpose of responding based on Article 6 (1) (b) GDPR and for the purpose of protecting our legitimate interests according to Article 6 (1) (f) GDPR.
In addition, you can interact with us by means of sharing, liking, retweeting, tweeting about tweets and following us. We will then use your personal data (user name, profile picture, date and time of interaction) on the basis of Article 6 (1) (f) GDPR.
